- A court ruled that Cuccinelli?s appointment as acting Director of USCIS was against the law. On March 1, a judge ruled that Ken Cuccinelli?s appointment as acting director for USCIS violated the Federal Vacancies Reform Act and was therefore invalid. The act requires officials temporarily filling in cabinet positions without Senate confirmation to either be next in the line of succession for the position or must have worked as a senior official in the agency for at least 90 days. Cuccinelli fulfilled neither of these requirements. It is unclear how this ruling will affect his position in USCIS, but it does invalidate two policies put in place since during his tenure. The nullified policies limited asylum seekers? ability to consult with counsel.
- USCIS published updated guidance on requirements for temporary workers in sheep herding. On February 28, USCIS published updated guidance on H-2A petitions, clarifying that sheep and goat herders have the same requirements as all other temporary agricultural workers. The focus is on making sure the workers are filling in only temporary or seasonal positions. This is effective starting June 1, 2020.
- A proposed fee schedule would raise the fee for challenging deportations to $1000. On Thursday, the Trump administration published a proposed regulation that would increase fees. The fee to appeal a deportation order would increase to $1000, nearly ten times the current fee. The same proposal would institute a $50 fee to asylum seekers. The proposed fees are open for comment for 30 days.

ICE has been accused of targeting parents taking their children to school. ICE agents in Colorado have been criticized for detaining parents who are taking their children to school. In the past week, there were 3 instances in Colorado where fathers were detained before or after dropping their children off at school. This has happened in Oregon and Pennsylvania as well. ICE has a ?sensitive location? policy prohibiting them from making arrests at schools, churches, hospitals, and more. However, this falls just outside that policy. ICE has said that it does not target fathers or schools, but it can stop vehicles that are traveling
