USCIS has Temporarily Suspended Premium Processing
- USCIS has temporarily suspended premium processing for I-129 and I-140 petitions. Due to the corona virus outbreak, USCIS has announced a temporary suspension of premium processing for all I-129 and I-140 petitions. This suspension is effective until further notice. USCIS will still process petitions with previously accepted requests for premium processing. If no action is taken on those petitions within the premium processing window, a refund will be issued for the premium processing fee.
- USCIS has announced flexibility in required signatures during the national emergency. Due to the COVID-19 outbreak, USCIS will accept all benefit forms and documents with reproduced original signatures; a wholly original signature will not be required on every form.
- Immigration courts are still open around the country. Despite growing numbers of cases of COVID-19 and the risks of infection that hearings pose, immigration courts around the U.S. are still open. Some immigration courts have been closed in major cities. However, a long list of courts continues to stay open. CDC guidance states that people should keep at least 6 feet away from other people; in a courtroom situation, that is almost impossible to enforce.
- ICE detainees have launched a hunger strike in Newark. In response to the COVID-19 situation, ICE detainees held in Essex County Correctional Facility in Newark, New Jersey launched a hunger strike on March 17. Since then, two other detention centers have also seen hunger strikes. Their goal is to be immediately released, since any virus poses serious risks to the detained population. Additionally, ICE has been criticized multiple times over alleged sub-par medical care for detainees. The detainees did not give specific terms for release. Recently, prisoners in New York as well as one medical professional in an ICE facility have tested positive for COVID-19.
- A lawsuit seeking more funding for the 2020 census was dismissed. On March 18, a federal judge in New York dismissed a lawsuit that accused the federal government of under funding the census. The complaint argued that the Trump administration?s under funding of the census would lead to the under count of minorities, immigrants, and the homeless. The lawsuit sought an injunction that would require the federal government to fund the 2020 census with $770 million left over from prior appropriations. The plaintiffs have not yet decided whether to appeal.
