F-1 Student: Employment
F-1 International Students are allowed to work in certain circumstances. In these circumstances, international students will require employment authorization from the United States Citizenship and Immigration Service. The employment is restricted to certain times and certain employers depending on the type of employment authorization.
Unauthorized employment is a complex matter even when it is unpaid. If the student was working on a business startup or self-employed without any current remuneration, this would be considered unauthorized employment. If student was working as a volunteer to gain experience which is usually a paid position, this may be considered unauthorized employment.
- On-Campus Employment is allowed for work at the school or affiliated off-campus location. The employment must directly involve services to students. Working on-campus is a benefit of the F-1 visa status and no additional employment authorization is necessary, but a social security number is provided to the international student. The social security number is required for the school to pay the F-1 student.
- Optional Practical Training (OPT) provides an opportunity for an F-1 student to obtain real life practical work experience in the United States following the completion of an academic program. The F-1 student will have to apply for OPT Employment Authorization. The OPT Employment Authorization will provide the student a 12-month period to work in a field related to their degree. If the student begins a new academic program at a high level such as a master?s degree after a bachelor?s degree, the student can obtain another 12-month period of OPT Employment Authorization.
- Curricular Practical Training (CPT) is employment that is part of the establish curriculum of a class such as a work/study program, cooperative education, or an internship that is part of the school program. There are two types of CPT ? Part Time vs. Full Time. Part-time CPT is employment of less than 20 hours per week and there is no limitation on the length of time as long as the F-1 student is enrolled in a full class schedule. Full-time CPT is employment of more than 20 hours per week. Full-time CPT of 12 months or more will remove the ability for F-1 Students to obtain Optional Practical Training (OPT). CPTs are not available for English Language Programs.
- OPT STEM Extensions are available for current OPT students who graduated with a STEM degree. STEM stands for Science, Technology, Engineering, and Mathematics. Those F-1 students who are currently working for a U.S. employer in a job directly related to their STEM major area of study can obtain 17 months OPT extension for a total OPT period of 29 months. Only one OPT STEM Extension is allowed per student.
- International Organizations may employ F-1 students if the organization is an international organization recognized by the U.S. Department of State. Students must maintain a full course load and moving toward a degree. The student must have written job offer but cannot begin to work at the organization until they receive their employment authorization document. There is no limit on the length of time for the employment as long as the student is fully enrolled in classes.
- Severe Economic Hardship can allow an F-1 student to be eligible for off campus employment if they have been in valid F-1 status for at least one academic year and be in good standing. The economic hardship must have been unforeseen and beyond the student?s control. On campus employment must neither be available or financially sufficient. Off campus employment does not count towards the ability to work on campus or affect the eligibility to obtain practical training.
The reasons for severe economic hardship may be the loss of financial aid or on-campus employment, currency exchange rate drop, inordinate increases in tuition or living costs, unexpected changes in the student?s source of support, or unexpected substantial expenses. The student may work up to 20 hours off-campus and the employment authorization is granted for one year or for the remainder of the academic program, whichever period is less.
Unauthorized employment may result in the F-1 student being removed from the United States and blacklisted from applying for another visa. This could be seriously detrimental the future career prospects of a student if their job required them to travel to the United States. It is important to speak with someone who is knowledgeable on the effect of student employment.
